Demagoguing Deportation

The political and media demagoguery opposing deportation of illegal aliens is a perfidious force in our country. I recently heard Fox News reporter Bill Reilly characterize deportation as "dragging" illegal aliens back to Mexico or their home country. During the recent Republican debates, someone characterized deportation as "ripping" families apart.

The facts:

1. No child of illegal aliens is required to remain in the U.S. if their parents are deported. Their children born here are dual nationals and enjoy the same citizenship rights as their parents in their home countries, at least to age 18. It's call juste sanguine. It is based upon international protocol to protect dual national children (sometimes called "anchor babies" in the U.S.) and it allows the parents to make the decision on whether to leave children behind or take them with them back to their homelands. Child welfare workers may require court-ordered custodial guardians if the children are left behind.

2. No illegal alien has ever been deported from the United States without Constitutional due process.

3. Deportation Procedure probably has more avenues of appeals than any other legal proceeding.

4. There is a Board of Immigration Appeals that can overrule an immigration judge.

5. If all other avenues of appeal fail, an illegal alien still has the right to judicial review. This means that any case with merit can be transferred to a U.S. Court.

Fortunately, the overwhelming majority of deportees agree to waive a hearing before an immigration judge and request a voluntary departure to Mexico, or to Guatemala. These countries, which have relatively high numbers of illegal entrants into the U.S., do not require their foreign consuls to be notified and therefore consuls do not automatically interview every deportee. This procedure has often been demagogued by the Mexican Government, blaming the U.S. for not allowing all deportees to see their consuls before deportation. Nothing could be further from the truth. It is Mexico's own policy to not give interviews to all deportees. To do so would require the commitment of enormous manpower and monetary resources. Moreover, nationals from these two countries know that it is easier to return to their home countries, then re-enter the U.S. illegally, than to undergo the time and expense of a deportation proceeding, which can drag out for months.

It is easy for political and news media demagogues to make scapegoats of the immigration law enforcement agencies of the U.S. Government. False charges by the media and politicians of violating the rights of illegal aliens is standard fare. Most of the time the government cannot respond to more than a small number of the enormous amount of frivolous and trumped-up complaints. Moreover, the news media has no interest whatsoever in telling both sides of the deportation story, or in telling the unbiased, unvarnished truth. The only chance the public has for learning the truth about immigration deportation procedures is a few blogs like this, but most are mere cries in wilderness. Most Americans, and especially our demagogue politicians and news media, do not even want to know the truth when lies and distortions are easier than doing a little research--and serve their purposes much better. Anyone willing to learn the truth about deportation procedures can research the following sections of immigration law: 8 USC 1251, 8 USC 1225, 8 USC 1324 and 8 USC 1123. All are available on the Internet.

Deportation goes on daily in this country. It is the only fair way to handle illegal immigration. Amnesties only exacerbate the problem and encourage more contempt for, not only immigration laws, but for all of our laws--and the rule of law itself. We have had three amnesties for illegal aliens in the past 35 years [IRCA, 245(i) and Extension of 245(i)], the last one in the past ten years. Those who say we cannot deport illegal aliens are the problem. We can, just as we did when Eisenhower was President, and once we show resolve, there will be a mass exodus of illegal aliens back to their home countries, just as there was in 1954. A national I.D. card with sanctions against employers, and illegal aliens alike, would stop illegal immigration in a heartbeat.

Many illegal Mexicans in the U.S. own free farm land in Mexico (called "ejidos") and free farm implements that they may check out from their government owned co-ops. While they are here illegally, most of them pay friends or relatives to occupy the ejidos in order that it not be re-possessed and re-issued by their Mexican government. A local "Commissario" oversees the farms. These farms are self-sufficient and most produce enough crops and livestock to support their families, just as our own farmers were self-sufficient during the Great Depression (I remember it well). They all produced milk, butter, lard, eggs, garden vegetables, pork and beef. they bartered for such staples as syrup. Most of them made their own bread (biscuits) in those days. If there was no money, chickens were used as a medium of exchange to buy a few necessities.

U.S. Appeals Court Oversteps Authority

Today, I hear over CBS Evening News that the Appeals Court of the U.S. has suspended some parts of the new Alabama immigration law. One part they suspended was that which requires aliens to prove their status in the U.S.

It appears the Appeals Court has overstepped its authority and is invalidating existing federal immigration law.

United States Law, 8 USC 1304(e) requires that all aliens in the U.S. prove they are legally in the United States. There are fines and jail sentences imposed upon violators.

Here is the text of the law that applies to legally admitted aliens:

(e) Personal possession of registration or receipt card; penalties
Every alien, eighteen years of age and over, shall at all times
carry with him and have in his personal possession any certificate
of alien registration or alien registration receipt card issued to
him pursuant to subsection (d) of this section. Any alien who fails
to comply with the provisions of this subsection shall be guilty of
a misdemeanor and shall upon conviction for each offense be fined
not to exceed $100 or be imprisoned not more than thirty days, or
both.

If a legally admitted alien for permanent residence is required to carry proof of his/her legal status at all times, it follows that an illegal alien would not get preferential treatment and be exempt from presenting proof of lawful status in the United States. The Appeals Court seems to be trying to legitimize illegal activity.

Would-be Iranian Assassins

I have read that the so-called Iranian, would-be assassin of the Saudi Ambassador to the U.S. should be prosecuted as a traitor. However, there are many potential terrorists in the U.S. who become U.S. citizens (in name only) through naturalization. Our globalist Government has betrayed the United States, and shown contempt for it by cheapening U.S. citizenship through allowing easy naturalization, especially of the citizens of the oil-producing countries in the Middle East. It all started in 1977.

In October, 1977, President Carter began the policy of ordering the INS to allow Iranian citizens to keep their native passports when they naturalized as U.S. citizens. Jimmy Carter and the other members of the Trilateral Commission globalists thought that the Shah would regain power in Iran. The practice quickly spread to all other countries. It is de facto perennial dual nationality granted by Carter's edict, even though by international law, dual nationality ends at age 18. Most dual nationals become such as anchor babies, not through naturalization. Dual nationality after naturalization as a U.S. citizen is a fiction created by Jimmy Carter.

The Victims of Amnesty

The main victims of yet another immigration amnesty are those who abide by the law and wait patiently for an immigrant visa number. Usually, in the past, when an amnesty is granted, either present quota immigrant visa numbers are used, or Congress creates a new quota for them. In either case, Congress will make a feeble effort to compensate for their crime by reducing quotas of legal immigrants in the immediate following years. Several decades ago, in the Pre-Kennedy years, Congressmen acted half way responsible and recognized the importance of maintaining immigrant quotas. It has to do with limiting immigration to numbers that we can absorb and assimilate. This means low enough quotas that will encourage the new immigrants to learn English, to obey American laws and adjust to our moral values. However, since 1987, our nation's leaders have thrown caution to the wind and politicians advocate virtually no limit to immigrants, especially illegal ones from third world countries.

Instead of exercising caution with respect to our sovereignty and our culture, Congress has created a huge bureaucracy called OBEMLA. OBEMLA's mission is to educate new immigrants in their native tongues.. What they have done is kill the incentive for largely illiterate immigrants from third world countries to learn English or assimilate into our culture or respect our moral values, include patriotism, of love for our country. These immigrants are taught by the left wing advocates of uncontrolled immigration that the United States as a colonial power stole this country from the Latinos, particularly the Mexicans.

This mode of thought gives the new immigrants an incentive to not assimilate; on the contrary to hold our Government in contempt. They are taught that the illegal invasion of the United States is justified in order for them to "take their country back." This psychology, encouraged and propagated by the subversive activists also supplies the new, illegal immigrants with a substitute for a legacy in the United States. Our legacy and history is part of the glue that holds Americans together and impels patriotism. Since illegal immigrants essentially have no legacy, other that that of a law violator who holds our country and Government in contempt. they therefore call themselves Reconquistadores. That has become a substitute for pride in their legacy. It is a rationale for what they really are: illiterate law violators with respect for none of our laws.

If we disregard the large numbers of would-be legal immigrants whose quota numbers are being stolen or usurped by the illegal aliens, then our country, our sovereignty and our country is the victim. The old argument that we are "a nation of immigrants" and that "diversity is good" are mere dissembling rationalizations of the irresponsible inaction of our Congress and President.

Scroll down to the chart and pay particular attention to the dates under "Mexico." These dates are the the dates that legal Mexican immigrants filed their applications for the indicated visa quota numbers--the filing dates for those who are receiving their immigrant visas today. As you can see, they are oversubscribed (backlogged) for many years. Politicians like Mike Huckabee, proposed to "streamline" the immigration visa issuance "system," in his ignorant belief that it is bureaucratic inefficiency causing the backlog. The backlog is caused by the great numbers of applicants for immigrant visas in proportion to the numbers of visas available. It is absolutely essential that we maintain quotas, and rather reduce them if we are to retain the national identity of our country, its culture and moral values.

The above irresponsibility of those proposing amnesty should highlight the reckless proposals of politicians like Rick Perry. Perry is a strong advocate of another amnesty for illegal aliens. He does not say that; he uses doublespeak and accentuates the antithesis, saying that he is "against mass deportation," and for a "guest worker" program. If we stop to analyze these statements, we realize that the only illegal aliens that Rick Perry wants to deport are those guilty of serious crimes, and protect those illegal aliens who have not yet been convicted of anything other than violations of our immigration laws (which, incidentally, is a felony; see 8 USC 1324). Perry has already granted sanctuary to those illegal aliens that he wants to protect from deportation, and he is giving them enormous education tuition discounts (up to $100,000 per alien, as Mitt Romney pointed out), Medicaid, free school lunches for their children, subsidized housing and many other welfare benefits. Since Perry wants to allow "clean" illegal aliens to remain as "guest workers," it becomes obvious that he wants to create a sub-class of workers who will never be able to vote (and become a threat to the Republican Party), hold political office, work for the government or do anything other than cheap, stoop labor. One can readily see that this plan will not work, for eventually these "guest workers" will get full amnesty and eventually become voting citizens. When that happens, "Flip Flop" Perry will probably resume his membership in the Democrat Party (which he left when the political wind in Texas" showed that they were becoming the minority political party).

Rick Perry is a typical Texas politician. He knows all that he has to do is be a notch more clever than the State's voters. His rhetoric and polemics are honed to exalt the international corporations and fool the rank and file Texans. Whether it will work with the rest of Americans is yet to be seen. Since I consider him Bush III, I am not optimistic about his being rejected by Americans. As an Independent, Texan, I will again stay home at election day, if Perry is the "conservative" nominee.

Deportation Could Be Easy

The word "deportation" in recent years has become anathema to those who pander to illegal aliens and their left-wing, subversive advocates who want to surrender our sovereignty and our culture.

Actually, there are firm, legal, and rather easy measures already in place that facilitate the deportation of illegal aliens. The DHS already has in place a Detention and Deportation Section (DDS) at every District office. Within the DDS, there es a subsection called "Bag and Baggage" (B&B) section. The DDS and B&B sections consist of professionally trained men and women whose job is to quickly and efficiently deport all illegal aliens who have been issued a final order of deportation. They include families and sometimes the families have children born in the U.S.(Anchor babies). Anchor babies do not guarantee a Kings X for their illegal parents, for the children are dual nationals at least until they reach age 18 and can return to their parents' home countries with them (with all benefits their home countries give them which includes much cheaper college tuition).

In 1996 the Inspector General of the Justice Department issued a policy letter outlining detention and deportation procedures, including those of the Bag and Baggage Departments. Back then, there were estimated to be only 4 million illegal aliens in the U.S., but like the present, the estimates are probably far too low. Some estimate that there are now more than 30 million illegal aliens in the U.S. and that number is not inconsistent with what we all can readily observe at the discount stores on any weekend.

Note that the policy letter shown at the below link is "sanitized," as the Inspector General is wont to do in cases where they do not want to reveal facts embarrassing to them or to the Government. You will note those sections are "blacked out." See:

To make deportation easy, all our government has to do is to properly fund the Detention and Deportation sections and the Bag and Baggage subsection of ICE. This might require opening some temporary detention centers, for which some recently close military bases might serve. Once a crackdown becomes apparent, most illegal aliens will flee to their home countries as they did in 1954 during the "Drive" of that year. Contrary to popular opinion, illegal aliens value their freedom and detest detention and jail. They are the epitome of the of freedom of lateral mobility.

Of course, the observant citizen knows that our Government has no intention of getting rid of our illegal aliens. That is the reason that they will not fund proper Detention and Deportation and Bag and Baggage sections of the DHS. The Republicans and the Democrats alike have a vested interest in the exploitation of cheap labor, and the Democrat Party has a vested interest in using them to grow their numbers; and their Congressmen will see that their legalization and naturalization (and voter eligibility) are expedited after each amnesty.

Rick Perry's Chinny Chin Chin

Presidential Candidate Rick Perry is gambling that America did not learn anything from the last "good old boy" they elected to a disastrous 8 years as president. This Texas conservative writer warned everyone back in 2000, and now, in 2008, we are saddled with $16 trillion in national debt, more than half of it attributable to George Bush Jr. Also due to Bush, we are engaged in two no-win, no-end wars.

It is axiomatic that Americans have short-term memories and that they do not heed history. Now comes Rick Perry who postures as being a "border control" candidate when the opposite is true. He is pandering to the simpletons who perceive themselves as "conservatives" and think that border control consists of guns, troops and the employment such gadgets as cameras (blue servo), sensors, drones, aerostats, and other devices dedicated only to "catching" illegal aliens, not to deporting or punishing them, or dedicated to deterring them from re-entry after getting "caught." The status quo will keep border patrolmen engaged in cat and mouse games and keep the revolving door for illegal aliens oiled and working. Perry has never proposed lengthy detention and/or deportation of illegal aliens as required by law (8 USC 1251 and 8 USC 1252), and defense of our borders as required by the U.S. Constitution, Article IV, Section 4.

Perry is dedicated to maintaining the status quo on illegal immigration, just as every other major Texas politician has done since Reconstruction. They all still have the plantation attitude and see Hispanics as inferior specimens of humanity whose purpose is to do the white man's labor. He cares nothing about protecting jobs or wages of legal residents, Hispanics, Anglos, African-Americans or others. The "cat and mouse" game began in 1952 when powerful Texas Senator Lyndon Johnson, managed to get injected into the I&N Act of 1952 the "Texas Proviso" that decriminalized transporting, harboring and concealment of illegal aliens by their employers. Perry is a chip off the old Texas Bloc. They posture as being "compassionate" when their true aim is exploitation of what they consider inferior specimens of humanity. Every Democrat Hispanic should cross lines and vote in the Republican primary election to see to it that Perry does not get the Republican nomination. (Obama will be unopposed in the Democrat primaries and does not need their votes.)

The Texas Dream Act:

Perry's true colors have been exposed numerous times in many different ways, but he still seems to portray himself as a "conservative." The most recent transparency has been in his support of resident tuition rates for illegal aliens who attend any state-supported institution. He never explains why he would educate people who cannot work here because they are here illegally. Perry is in concert here with the Democrats who have similar anomalous ambitions and call them the "Dream Act" for illegal aliens. It appears that Perry's many years as an erstwhile Democrat politician still make him top-heavy with Democrat ideas. The "Texas Dream Act" shows that he has no intention of deporting illegal alien students or their extended support families.

E-Verify:

E-Verify is one of the most effective deterrents against illegal immigration that has so far been devised. It enables those who are sincere in wanting to hire legal residents a device by which they can verify the status of illegal aliens. Perry is opposed to this policy for rather enigmatic reasons. The real reason, of course, is that he wants to maintain the status quo and enable his wealthy plantation constituency to continue hiring illegal alien labor.

There are many other important reasons that Texans and Americans should oppose Rick Perry, but the above reasons show the hypocrite that he is and they override his obvious globalist philosophy and his contempt for not only Texas, but American sovereignty as well.

About Welfare and Those Free Phones

What about those free cellphones for the poor? Why are they called Obama Phones? Actually this program was instituted during the Bush administration. Obama has recently given it emphasis, but if you want to blame someone, blame congress. Well, that's what the Tea Party is currently doing--attacking not only that welfare program, but the many others that we cannot afford.

By the way, the free phones will help politicians stay in touch with the poor, especially during election years. You can bet that the poor will get an earful from Democrats, and maybe even Republicans at election time via mass, recorded political messages disguised as "information" to those free, Government-provided cell phones. They do not have all the privacy protections that the more expensive cell phone plans have.

I recently added a cell phone to my account with my cell phone provider. Immediately, I started getting calls from dozens of bill collectors. I'll bet that one of those deadbeats with a free phone had that number before I got it. The cell phone provider said that they wait several months before they re-issue cell phone numbers...oh well. Anyway, I had to go back to the provider and get a new number. I got better service when I once had a pre-paid cell phone as a second phone during an emergency.

Another problem with providing cell phones (and up to 70 free minutes, which will soon be extended) to the poor is that they keep the air waves flooded most of the time with trivial calls to their many children and grandchildren. Don't count out drug dealers, pimps, prostitutes and those other professionals who inhabit our poverty-stricken communities. If we ever have a disaster, "the poor" won't be able to understand messages to stay off the phone--since most do not understand simple English. In the interest of "cultural diversity," left-wing political activists encourage new immigrants (legal and illegal) to keep their native culture and to resist assimilation. We spend more billions on a bureaucracy called OBEMLA to ensure that they do not assimilate. I would call all this a conspiracy to destroy us, but Americans are better at self-destruction than destruction by our enemies. How else could a Bush or a Carter or an Obama come to occupy the Oval Office?

Come on Tea Party. It may not be too late to save America. We need to not only clean out the Oval Office, but finish the clean-up of Congress and keep reminding congressmen who they are working for.

Do Illegal Aliens Really Pay Taxes?

One of the most repeated (and absurd) myths propagated by the advocates of open borders (i.e., non-enforcement of immigration laws) is that illegal aliens earn their keep by paying their share of taxes. The truth: thousands of illegal aliens shake down the U.S. Treasury for thousands of dollars every tax season and pay little or no income taxes at all.

Here's how it works:

A married couple filing jointly are not required to file an income tax return if their net income is less than $18,700 per year. Very few of the breadwinners of illegal aliens are required to file an income tax return because most do not earn $1500 per month of reportable income.

However:

Most illegal alien families DO file an income tax return even if their income is very low--say $10,000 per year, or less. They do it to collect the "shakedown" money called "tax credits," particularly those tax credits under line 49 and 51 of IRS Form 1040, education tax credits for their children (who attend public schools without paying non-resident tuition), and tax credits for children (for up to three).

How do they file an income tax return if they have no valid Social Security Card?

The IRS will issue any illegal alien an ITIN (Individual Tax Identification Number) for the purpose of filing a tax return, regardless of their income.

Top the above off with the fact that welfare income (food stamps, medicaid, two free school lunches per day, free cell phones (see "Obamaphones") + 250 free minutes per month, and dozens of other "entitlements" for which illegal aliens are entitled, DO NOT COUNT as "earned income," and do not affect eligibility for these handouts.

The Government's estimate for the number of 12 million illegal aliens in the U.S. is probably far to low. There are probably more Mexicans than that. Some estimate that there are over 30 million illegal aliens here.

Considering the above, could anyone wonder how, as a nation, we are $16 trillion in debt?

Whitewashing El Paso

The El Paso Times online edition used to be a good source of humor, especially the column by Ramon Renteria. Renteria is essentially a social commentator disguised as a "human interest" columnist. For years, critics have enjoyed chiding him each Sunday about his quasi illiteracy and mixture of "cholismo" with a not-so-fluent English. He often writes and rails about race and ethnicity issues, with a heavily biased tilt against Anglo American culture. Most clowns are actors, but Renteria is the consummate buffoon because he takes himself seriously.

Criticism of Renteria once got so bad that the El Paso Times online edition came out with a new editorial policy, requiring that all those posting comments on the erstwhile Topix message board (once available for a few carefully selected Times articles), now must identify themselves by posting through Facebook, or other means whereby they can be identified. Apparently, the Times thought that identifying each messenger would intimidate Renteria's critics from posting negative comments. In last Sunday's column, he lashed out at an anonymous telephone caller, claiming all his critics were afraid to confront him to his face. That brought on a surge of old critics, now identifiable by their Facebook profiles, to the comments section of his article, but nearly all were edited out, mostly no doubt by Renteria himself.

Well, the new Times policy did not deter any negative comments, but it made it much easier to delete them for no reason at all other than the fact that, though truthful, they were "offensive to the offenders"--such as Renteria. Before the new policy, other amateurish Times reporters also caught their share of criticism for poorly worded, poorly organized articles not infrequently containing misspellings, malaprop and other affronts to the conventions of our mother tongue. Apparently, they now let one or two negative commentators get through their censorship, to give Renteria's column a false appearance of being "fair and balanced," but most criticisms of Renteria and the City of El Paso are now edited out for no other reason than being negative, no matter how truthful and honest.

I enjoyed the negative posts and admit that I was sometimes a contributor. After all, teaching by antithesis is the method most preferred by the scribes in the Holy Bible. Unfortunately, in spite of heavy criticism, Renteria's writing has not improved at all. While his critics used to be 90% negative, now, thanks to careful censorship, and no doubt contributions by shills with multiple Facebook accounts, they are 90% positive. This new Times policy coincides with the El Paso Chamber of Commerce's, and City Hall's, efforts to censor anything negative about the City of El Paso. They sometimes censored even Topix comments if they reflected too negatively on the city, no matter how sincere and well stated, but back then it took more than just a click of a mouse.

Censorship of honest, quality and eloquent criticism smacks of totalitarian-type policies and reminds one of the government banishment of the best writers in Russia to the Caucasus as border guards in the mid 19th century (most of whom did not return alive). In spite of the City's and the C of C efforts, most outsiders are not convinced that El Paso is as "safe" a city, as they claim. The fact remains that it is also a "sanctuary city" where illegal aliens enjoy (illegal) immunity from arrest by the police for immigration-related crimes. Sanctuary cannot be limited to illegal aliens, for many of them are also criminals of various types, and sanctuary is therefore a dangerous, political practice.

The City of El Paso and its newspaper, the El Paso Times online edition, are ill advised in their new "image conscious" campaign. El Paso has never been seen by most Americans as a "tourist mecca," and never will be. With so many politicians and public figures being indicted in an ongoing FBI clean-up campaign of official corruption, whitewashing efforts are futile. But so are clean-up campaigns futile, for corruption and unethical conduct is embedded in the El Paso psyche and culture by tradition and have no doubt been influenced by affinity with its sister city across the Rio Grande.

Many outside visitors to El Paso and Juarez, have historically been motivated mostly by "slumming" urges. I remember when soldiers from as far away as Fort Carson, Colorado used to carpool and go down there for a wild weekend of debauchery and carousing. Common sense now dictates a more prudent selection of places to carouse, in spite of El Paso's newspaper, and the city's, whitewashing efforts. If, metaphorically speaking, tourists prefer "a clean, well-lighted place," as did Hemingway's deaf mute in the story by the same name, they won't go to El Paso or Juarez to find it.

The increase of the debt limit is his problem, as much as he'd like to palm it off on the Republicans. Obama does not negotiate in good faith because he puts nothing in writing; he thinks the Republicans should be naive enough to accept his word as gospel.

Are We Really Free?

Lately we have heard an unusual number of comments about "freedom," as refers the the United States. After reflecting upon the latest media emphisis on our "freedom," i thought about the recent turning of events that I do not think are consitent with a "free country."

Would a free country have a parliament or a congress that ignores its constitution and in particular our Constitution which requires the Federal Government to protect the individual states from foreign invasion (Article IV, part 4)? I do not think anyone will ask, "What invasion?" unless they have been living under a rock for the last fifty years. Illegal immigration is a foreign invasion that tramples upon our sovereignty by ignoring our immigration laws. Those invaders are in concert with our fifth-column socialists who see that the invaders are given comfort at the expense of the law abiding tax-payers by cosuming goods and services paid by the taxpayers. The overwhelming majority of Americans oppose illegal immigration and many think that legal immigration is too liberal and that quota numbers are too high already, if they were enforced. In a free country, its duly elected politicians would not ignore the will of its people.
